1. Understanding These Terms

1.1 These Terms and Conditions set out the basis upon which Canaima Services Ltd (“we”, “us”, “our”) provides building, renovation, painting, plumbing, carpentry, electrical, drainage, access control, CCTV installation, property maintenance and related services, including the supply of materials and products (“Goods”) required to complete the works (“Services”).

1.2 Services may be:

  • Emergency Services – where immediate attendance is required; or

  • Scheduled Services – where works are pre-booked.

1.3 “You” means:

  • A Consumer (an individual acting outside their business); or

  • A Business (any person acting for trade, business or commercial purposes).

2. The Order Process

2.1 Orders may be placed by phone or email.

2.2 A contract is formed when:

  • You accept our rates (Emergency Services); or

  • You accept a Verbal or Written Estimate (Scheduled Services) and pay any required deposit.

2.3 Estimates remain valid for 30 days unless withdrawn earlier.

3. Cancellation

3.1 Consumers have a 14-day cancellation right under the Consumer Contracts Regulations 2013 (excluding Emergency Services once commenced).

3.2 If cancellation occurs after work has started, you must pay for:

  • Work completed;

  • Materials ordered;

  • Any non-returnable goods;

  • Time reasonably incurred.

3.3 If cancelling or rearranging less than 24 hours before a scheduled appointment, we may charge reasonable costs incurred.

4. Charges & Payment

4.1 Charges will be:

Emergency Services

  • Charged at the hourly rate advised at booking.

  • First hour minimum charge.

  • Thereafter charged in 15-minute intervals.

  • Materials charged at trade cost plus margin (up to 45%).

Scheduled Services

  • Based on Verbal or Written Estimate.

  • Charges will not exceed:

    • 10% above a Verbal Estimate;

    • 20% above a Written Estimate (unless scope changes).

4.2 Deposits
Deposits are required as specified in your quotation.

4.3 Large Projects
For projects exceeding £20,000 (excluding VAT), staged payments will apply, typically:

  • 50% deposit;

  • Interim payments during works;

  • Final balance upon completion.

4.4 VAT is payable at the prevailing rate.

4.5 Payment Methods:

  • Bank transfer (instant transfer required)

  • Debit or credit card

  • Cash
    Cheques are not accepted.

4.6 Late Payment
Interest may be charged at 4% above the Bank of England base rate from the due date until payment is made in full.

4.7 A 1% + VAT transaction fee may apply to card payments.

5. Your Obligations

You must:

  • Provide safe, unobstructed access.

  • Provide working space, electricity and water.

  • Obtain required permissions (planning, landlord, building control).

  • Inform us of hazards (gas, asbestos, chemicals).

  • Provide parking or permits.

Parking Charges
Where parking is not provided and paid parking applies, parking charges of £10 + VAT per hour may apply (maximum 3 hours per day).

Failure to provide access may result in additional charges.

6. Our Obligations & Warranty

6.1 We will carry out Services with reasonable care and skill.

6.2 Workmanship Warranty
We provide a 30-day workmanship warranty from completion.

Warranty excludes:

  • Misuse or damage by third parties

  • Alterations by others

  • Pre-existing defects

  • Blockages in drains

  • Installations over 10 years old

  • Works completed against our advice

6.3 Materials Warranty
All materials are covered solely by the manufacturer’s warranty.

6.4 No warranty applies if full payment has not been received.

7. Termination

We may terminate the contract if:

  • You breach these terms;

  • You fail to make payment;

  • You fail to provide access;

  • Additional work is refused but necessary.

You must pay for all completed work and supplied goods.

8. Personal Information

We process personal data in accordance with our Privacy Policy available on our website.

9. Liability

9.1 Nothing excludes liability for:

  • Death or personal injury caused by negligence;

  • Fraud;

  • Any unlawful exclusion.

9.2 If you are a Consumer:
We are liable only for foreseeable loss directly caused by our breach.

9.3 If you are a Business:

  • We exclude liability for loss of profits, business, revenue or indirect losses.

  • Our total liability shall not exceed the lower of:

    • £500; or

    • The total Charges paid.

9.4 We are not responsible for delays caused by events outside our control.

9.5 We are not liable for scaffolding delays outside our control.

10. General

  • If any clause is invalid, the rest remain enforceable.

  • These Terms override any terms supplied by you.

  • Complaints should be directed to Enquiries@canaimaservices.com.

  • We may transfer our rights under this contract.

11. Governing Law

These Terms are governed by the laws of England and Wales.

Consumers may bring proceedings in English courts.

Businesses submit to exclusive jurisdiction of English courts.
